Terms and Conditions

These General Terms and Conditions of Sale apply to all sales of Products concluded at a distance through the Site and govern distance sales in accordance with and in compliance with applicable national and European regulations, including Legislative Decree. n. 70/2003, Legislative Decree. n. 206/2005 as amended (hereinafter, “Consumer Code”) and the European Directive no. 2011/83 EU on Consumer Rights.

  • All products in our catalog are exclusively produced by VAMA Divani with raw materials  Made in Italy.
  • All purchased products will be accompanied by regular delivery note.
  • On all products there is a two-year legal warranty  covering all manufacturing defects.
    All products marketed enjoy the legal guarantee of conformity provided for in Articles 128 et seq. of the Consumer Code, which covers any lack of conformity of the items purchased, existing at the time of delivery and manifested within 2 years of delivery. Excluded from the conformity defects and, therefore, from the legal warranty are any defects or damages caused by accidental facts or by the Customer’s responsibility for use of the products not in accordance with their intended use or effect of normal wear and tear.
    To benefit from this warranty, the Customer must report the lack of conformity by communication addressed to the seller indicating the defects and faults found. The Customer may request, at his or her option, that the seller repair the goods or replace them, without charge in either case, unless the requested remedy is impossible or would impose disproportionate costs on the seller. It should be noted that the Customer has no right to terminate the contract if the lack of conformity is only minor.
  • By confirming your purchase you agree to pay for the goods by the methods indicated in the terms of payment.
  • VAMA Divani will be responsible for the goods until they are received by the customer. Any problems arising from the shipment will fall under our responsibility and therefore it will be our duty to solve them.
  • VAMA Divani remains at fully dedicated to assisting our customers , both before and after the sale. Any problems can be reported to our number 0575.146.03.03.
  • Upon purchase you will receive a confirmation email indicating the goods purchased, the total price to be paid, including VAT and shipping costs, and the payment methods to be used.
  • All prices listed are inclusive of VAT.
  • Prices of upholstered beds are all exclusive of mattress i.e. including headboard, base and slatted base.

Right of withdrawal and complaints

Regarding the right of withdrawal, we refer to Legislative Decree 206/05, which states that the customer may exercise the right of withdrawal within the 14 days starting from the receipt of the goods.
To exercise your right of withdrawal, simply inform us of your decision to withdraw from this contract by writing an email to servizio.clienti@vamadivani.it on which you must indicate invoice or order number and date, item number and quantity for each item to be returned, reason for return, and indicate whether you would like a refund or a voucher for future purchases.
The customer must return the goods in their original packaging within 14 days of sending the notice of withdrawal.
The consumer has the right of withdrawal without any penalty, the only expenses to be borne by you are those related to the return of the product. We will notify you of the amount of the return charge and with your agreement refund what you paid minus the cost of collecting the goods. Alternatively, you can arrange shipping of the returned goods.

Once the products are received, a refund of the sums paid will take place as soon as possible and in any case within 14 days.

If you have a complaint against VAMA Divani as a result of purchasing a product or service and you have been unable to resolve it by contacting our Customer Service Department, remember that you have the option of submitting it through the ODR platform (Online Dispute Resolution Platform), operated by the European Commission. The place of jurisdiction in case of disputes in consumer relations, which pursuant to Art. 66-bis Legislative Decree. 206/2005 (Consumer Code) is mandatory the Court of residence (or domicile) of the consumer.
